In 2009, the Supreme People's Court launched the annual themed activity of "optimizing legal environment for independent innovation," in the field of IPR trial. Haikou Intermediate People's Court played a role of unique functions on IP trial for the overall situation of guaranteeing growth, protecting people's livelihood, maintaining stability," based on practice and focused on key points, " and achieved gratifying results.
It is introduced that, as the capital city's Intermediate People's Court, Haikou Intermediate People's Court is responsible of first instance trials task for the vast majority of intellectual property rights disputes in Hainan Province. In 2009, the court handled 37 cases of intellectual property disputes, including: 10 copyright disputes; 18 trademark disputes; 6 patent disputes; 2 unfair competition disputes; and 1 other dispute.
Since the successful rights protection of domestic and international famous brands including "Hero", "Ctrip", "Puma" in Haikou 2008. In 2009, the register of "Hero" trademark filed nine lawsuits again in Haikou Intermediate People's Court, the cases have been completed, of which eight reconciliations, one was judged. In recent years, Haikou Intermediate People's Court also has successive trials of number of film and television infringement disputes involving the "Fearless," "Seven Swords", "to Northeast", "The Warlords", and effectively cracked down on violations of copyright piracy in the neglect of others.
It is learnt that, Haikou Intermediate People's Court heard a total of 36 cases of intellectual property rights disputes in 2009, the rate of settlement was 97.3%, and the rate of mediation and withdraw accusation was 69.44%, accounting for 84% of the settlement cases. Most of the intellectual property rights disputes can be settled by mediation, which became the highlights of IPR trial work of Haikou Intermediate People's Court in 2009.
