Goldlion sued six supermarkets for trademark infringement

Goldlion as a well-known leather brand is popular among consumers. Goldlion handbags and leather shoes especially take the fancy of the public. How can a Goldlion belt priced 35 yuan be genuine? Goldlion found six franchised supermarkets located in Jiaxing City of Zhejiang Province sell belts and wallets stuck with Goldlion logo at a cheap price and thus brought them before the court.

The plaintiff, Goldline-China Co., Ltd., stated in the complaint that Goldline (fareast) Co., Ltd. as the registrant of Goldline trademark signed a trademark licence contract with the plaintiff in 2001 and 2009 respectively, allowing the latter to use Goldline trademark in Mainland China.

Not long ago, the plaintiff found that six franchised supermarkets in Jiaxing sell counterfeiting belts and wallets with a trademark identical or similar to Goldline trademark. The coarsely made counterfeits not only imposed a negative impact on the sales of plaintiff's products but also damaged plaintiff's long-built branding reputation.

It was reported that the involved defendants were mostly well-known franchised supermarkets, including TrustMart and Century Hualian.

The plaintiff complained that the defendants as professional commercial sales units should have the discriminating capacity and fulfill their duties toward fighting counterfeiting; contrarily, what they have done not only damaged consumers' legal right but also infringed the plaintiff's trademark.

The plaintiff required the court to order each defendant to stop infringements and compensate the plaintiff for 60,000 yuan in damage for economic loss plus 7,000 yuan incurred by reasonable investigation.

Nanhu District People's Court has accepted the case.
