SAIC regulates trademark examination standards |

The Trade Mark Office under State Administration for Industry and Commerce firstly publicized the examination standards for trademarks containing Chinese characters"中国" or the initial of which is the character "国". It is informed that all the applications for trademarks in the format of "国+the name of merchandise bearing the trademark" or the name of the trademark containing "国+the name of merchandise bearing the trademark" such as "国酒"，"国烟" and "国茶" will be rejected due to exaggerating publicity and fraudulence, lack of notable characteristics and bad influence. Those marks with initial character "国" but not in the format of "国+the name of merchandise bearing the trademark" should be treated differently unless the sign possesses fraudulence and will do harm to fair competitiveness. The sign containing "中国" can be submitted for preliminary examination if it satisfies the following four requirements. First, the subject qualification of the applicant should be set up with the approval of the State Council or its authorized entities; second, the filing trademark should be in accordance with the name of the enterprise or its short form; third, the trademark and the subject of the applicant should have close corresponding relationship; and the scope of merchandise or service to bear the trademark should be consistent with the checked business scope of the enterprise. |
